Database Rights and Data Extraction
This section supplements the Terms and Conditions below and forms an integral part of them.
The print run figures, quantities, pull odds, breakdowns and any other numerical or statistical data available on www.mtgprintrun.com (the “Database”) constitute an original database compiled, verified and maintained by the Owner through substantial investment and proprietary research methodology. The Database is protected as such under Directive 96/9/EC (sui generis database right), as well as under applicable copyright and unfair competition laws.
Access to the Database — whether free or through a paid subscription — is granted to the User as a personal, non-exclusive, non-transferable and non-commercial license for individual consultation only.
Users may not, under any circumstances:
- extract, re-utilize, reproduce or redistribute the whole or a substantial part of the Database, in any form or medium;
- perform repeated and systematic extraction or re-utilization of insubstantial parts of the Database, where such acts conflict with a normal exploitation of the Database or unreasonably prejudice the legitimate interests of the Owner;
- scrape, crawl, download or copy the Database or any part of it by automated means;
- publish, share, sell, license or otherwise make available any data obtained from the Database to third parties, including on websites, forums, social media, marketplaces, spreadsheets, datasets or applications.
Brief quotations of individual data points for non-commercial discussion purposes are permitted only with clear attribution to www.mtgprintrun.com as the source.
Any breach of this section constitutes a material breach of these Terms and will result in the immediate termination of the User’s account and subscription without any refund, without prejudice to the Owner’s right to seek damages and any other remedy available under applicable law.
